Human rights and educational public association “Movement” For Freedom" (The Movement “For Freedom”)

  1. General Provisions

1.1. Human rights and educational public association "Movement "For Freedom "(hereinafter — The “Movement “For Freedom”) — republican public association, which brings together, on a voluntary basis, citizens of Belarus for joint realization of civil, social, cultural and other rights.

1.2. The “Movement “For Freedom” acts on the territory of Belarus in accordance with the Constitution of the Republic of Belarus, the Law of the Republic of Belarus “On Public Associations” and other norms of legislation, the present Statute, in accordance with the principles of legality, voluntariness, independence and transparency.

1.3. The activities of The “Movement “For Freedom” covers the entire territory of the Republic of Belarus.

1.4. The “Movement “For Freedom” has a full name:

in Belarusian — Pravaabaroncha-asvetnitskaye hramadskaye abyadnanne “Rukh “Za Svabodu”;

in Russian — Pravozaschitno-prosvetnitskoye obschestvennoye obyedineniye “Dvizheniye ‘Za Svobodu’;

1.5. The abbreviated name of The ‘Movement’ For Freedom ”:

in Belarusian — PAHA “Rukh “Za Svabodu”;

in Russian — PPOO “Dvizheniye “Za Svobodu”.

1.6. The “Movement “For Freedom” from the moment of registration is a legal entity, has its own balance, may have a settlement, currency and other bank accounts, on its behalf shall enter into a relationship with the physical and legal entities, acquire property and personal non-property rights, advocate in the court. Under its obligations “Movement “For Freedom” is responsible for its own property. The “Movement “For Freedom” is not liable for obligations of its members, and the members of The “Movement “For Freedom” are not liable for obligations of The “Movement “For Freedom”.

1.7. The “Movement “For Freedom” may participate in the creation of unions (associations) of Belarusian non-governmental organizations and to join them, to take part in the creation of international unions (associations), non-governmental organizations and to join them, to maintain international contacts, carry out other activities that do not contradict the legislation of the Republic of Belarus, including international agreements.

1.8. The “Movement “For Freedom” has a seal, stamp and letterheads with its name, and can also have an emblem and symbols that are registered in the order established by the legislation.

1.9. The activities of The “Movement “For Freedom” are carried out in accordance with legal requirements. Documentation, which is defined by the legislation, shall be in archival institutions according to the location of the organization.

2. Purpose, objectives, subject and methods of The “Movement “For Freedom”

2.1. The aim of The “Movement “For Freedom” is protection of human rights and freedoms enshrined in the Constitution of the Republic of Belarus and in the international documents on human rights and citizens’ education in this field.

2.2. The objectives of the The “Movement “For Freedom” are:

  • to contribute to building a civil society and rule of law, uphold the principles of freedom, democracy and human rights;

  • to promote the independence and sovereignty of the Republic of Belarus, raising its international prestige;

  • to promote conditions for Belarus universal, free and equal election of the president and deputies in accordance with international standards.

2.3. The subject of the activities of The “Movement “For Freedom” is advocacy and educational activities aimed at achieving the statutory goals and objectives of The “Movement “For Freedom”.

2.4. To achieve its statutory goal, The “Movement “For Freedom”, under the legislation, solves its issues by means of the following methods:

  • comprehensive support of activities that contribute to strengthening the sovereignty and independence of Belarus;

  • representation and protection of rights and legal interests of its members in state, business and public bodies and organizations;

  • participation in the electoral process in accordance with the procedure established by the legislation of the Republic of Belarus;

  • analysis of legislative and other normative acts;

  • implementation of programs and activities consistent with the statutory purpose and objectives;

  • cooperation with the mass media;

  • development and preparation for publication of popular science, information, reference and other literature;

  • organizing and conducting meetings, lectures, seminars, workshops, exhibitions, presentations, competitions, festivals and concerts, conferences, symposia, including international;

  • the establishment of their own media and publishing activity in the manner determined by law;

  • conducting opinion polls in the manner determined by the law;

  • support civil actions and the protection of human rights initiatives.

2.5. Activities, the implementation of which requires a special permit (license), are conducted only after receipt of a permit (license) in the prescribed manner.

3. Membership in The “Movement “For Freedom”

3.1. Membership in The “Movement “For Freedom” is voluntary. The “Movement “For Freedom” offers a fixed membership.

3.2. Members of The “Movement “For Freedom” may be citizens of Belarus who have reached 18 years of age, recognize its Statute, are involved in the realization of its goals and objectives.

3.3. Acceptance of new members in The “Movement “For Freedom” is carried out by the Assembly of the city, the district branch of the Council of regional (Minsk City) branch, and in case of their absence — the Board of The “Movement “For Freedom” on the basis of a written application of the candidate.

3.4. Records of members of the municipal, district and regional (Minsk City) offices, are kept by the heads of the relevant departments. The total records of members of The “Movement “For Freedom” are kept by the Board of The “Movement “For Freedom” by maintaining total list of members, which is renewed when a member joins or leaves the Association. The Board of The “Movement “For Freedom” shall designate a person responsible for keeping records of members of the association.

3.5. According to the decision of the Board of The “Movement “For Freedom”, a member of The “Movement “For Freedom” can be awarded the title "Honorary member of The “Movement “For Freedom” for his merits and hard work.

3.6. Membership in The “Movement “For Freedom” can be terminated as a result of:

  • leaving the The “Movement “For Freedom” at the member’s own request, as expressed in the form of a written application to the Head of the city, district, or regional (Minsk City) branch, and in case of their absence, to the Chairman of The “Movement “For Freedom”, which will be considered by them;

  • expulsion from the organization by the Board of The “Movement “For Freedom” for gross violation of the Statute. In the case of exclusion from The “Movement “For Freedom”, the member has a right to appeal against this decision to the Conference.

4. The rights and obligations of the members of The “Movement “For Freedom”

4.1. Members of The “Movement “For Freedom” have equal rights and duties.

4.2. Members of The “Movement “For Freedom” have the right to:

  • elect and be elected to all elective bodies of The “Movement “For Freedom”;

  • participate in the activities of The “Movement “For Freedom” and in the activities, that they carry out;

  • use the services and support of The “Movement “For Freedom” in the implementation of statutory objectives and tasks;

  • receive advice and assistance, use the assistance of The “Movement “For Freedom” in the protection of their rights and interests;

  • provide help to The “Movement “For Freedom”, or to make donations in cash or in the form of property;

  • attend the Conference and the meetings of the Board of The “Movement “For Freedom”;

  • appeal against decisions of the elected bodies in the manner determined by the present Statute;

  • leave the Association on their own initiative.

4.3. Members of The “Movement” For Freedom "must:

  • recognize and respect the Statute of the The “Movement “For Freedom”;

  • participate in the implementation of the objectives and tasks of The “Movement “For Freedom”, its projects and programs;

  • not to commit actions which discredit The “Movement “For Freedom”, not to cause to The “Movement “For Freedom” material damage or harm its business reputation;

  • value property of The “Movement “For Freedom”.

4.4. Upon withdrawal or expulsion from the members The “Movement “For Freedom”, financial or proprietary financial contributions, which have been transmitted to The “Movement “For Freedom”, are non-refundable, unless otherwise specified in the contract.

5. Structure of The “Movement “For Freedom”

5.1. The “Movement “For Freedom” in accordance with the law has the right to establish its organizational structure: the municipal, district and regional (Minsk City) office.

5.2. Urban district offices may be established in the presence of three or more members of The “Movement “For Freedom”, who live in the corresponding territory, according to the decision of the Board of The “Movement “For Freedom”.

5.3. The supreme body of city and district branch is the Assembly, which shall meet as often as needed but at least once every four years.

Meeting of the city and district branches:

  • elects the chairman of the city and district offices and his deputy, Inspector of the Department for the period of four years;

  • hears and discusses the report of the chairman of the city and district offices, evaluates his activities;

  • determines the main directions of activity of the city and district offices in accordance with the Statute and the decisions of the Council, the Conference of the The “Movement “For Freedom”;

  • accepts new members of The “Movement “For Freedom”;

  • elects, in accordance with the norm of representation, which is determined by the Board of The “Movement “For Freedom”, the delegates to the Conference of The “Movement “For Freedom”;

  • takes decisions that are binding for the bodies of the city and district offices and the members of The “Movement “For Freedom”, of which it is comprised.

Meeting of city and district branches is competent if it is attended by more than half of the members of The “Movement “For Freedom”, who live on the corresponding territory.

The decisions of the Assembly are taken by a simple majority of those present.

5.4. Chairman of the city and district branch of The “Movement “For Freedom”:

  • supervises its activities in the period between Assemblies;

  • implements the decisions of the Assembly of the city and district branch, of the Conference, of the Board of The “Movement “For Freedom”;

  • keeps records of members of the respective branch of The “Movement “For Freedom”;

  • performs organizational and administrative functions in accordance with the purpose and objectives of The “Movement “For Freedom”.

During the absence of the Chairman his functions are carried out by the Deputy Head of the Association.

5.5. Auditor of the city and district branch of The “Movement “For Freedom”:

  • monitors the compliance of the activities of the city and district office, of its chairman, Statute, decisions of the Conference and Council of The “Movement “For Freedom”;

  • controls the management of the activities.

  • auditor of the city and district department carries out inspections as required, but not less than once every four years.

5.6. Regional (Minsk City) offices may be established in the presence of ten or more members of The “Movement “For Freedom”, who reside on the appropriate territory, according to the decision of the Board of The “Movement “For Freedom”.

5.7. The supreme body of the regional (Minsk city) department is the Assembly, which shall meet as often as needed but at least once every four years.

Meeting of the regional (Minsk city) departments:

  • elects the Board and the Audit Committee of the regional (Minsk city) department for the period of four years, determines their number of members;

  • hears and discusses reports from the Board and the Audit Committee of the regional (Minsk city) department, evaluates their work;

  • determines the main directions of activity of the regional (Minsk City) office in accordance with the Statute and the decisions of the Council, the Conference of The “Movement “For Freedom”;

  • elects, in accordance with the norm of representation determined by the Board of The “Movement “For Freedom”, the delegates to the Conference of The “Movement “For Freedom”;

  • takes decisions that are binding for the bodies of the regional (Minsk city) department and members of The “Movement “For Freedom”, of which it is comprised

Meeting of the regional (Minsk city) department is competent if it is attended by more than half of the members of The “Movement “For Freedom”, who reside on the corresponding area.

The decisions of the Assembly are approved of by a simple majority of those present.

5.8. In the period between meetings of the regional (Minsk city) department of The “Movement “For Freedom”, the governing body is the Council, which supervises the activities of the regional (Minsk city) department.

The Council shall meet as required, but at least once every six months. Council meeting is competent if it is attended by more than half of its members.

The decisions of the Council are approved of by a simple majority of those present.

Council of the regional (Minsk city) department:

  • implements decisions of the Meeting of the regional (Minsk city) branch, the Conference, the Board of The “Movement “For Freedom”;

  • elects from its members the Chairman of the Council (Minsk City) as well as the Deputy Chairman for the period of four years;

  • accepts new members of The “Movement “For Freedom”;

  • resolves other issues regarding the statutory activities within its competence.

5.9. The Chairman of the Board holds meetings and directs the work of the regional (Minsk City) Council branch of The “Movement “For Freedom”.

Chairman of the Regional Council (Minsk city) department of The “Movement “For Freedom”:

  • implements decisions of the Meeting and the Regional Council (Minsk city) branch, the Conference and the Board of The “Movement “For Freedom”;

  • is responsible for general management of the regional (Minsk City) department;

  • keeps records of members of the respective branch of The “Movement “For Freedom”;

  • performs organizational and administrative functions in accordance with the purpose and objectives of The “Movement “For Freedom”.

During the absence of the Chairman of the Board of the regional (Minsk city) department his functions are performed by the Deputy Chairman.

5.10. The Audit Commission of the regional (Minsk city) department of The “Movement “For Freedom” is elected in the amount determined by the Assembly of the regional (Minsk City) branch, for the period of four years.

The Audit Commission of the regional (Minsk city) department of The “Movement “For Freedom”:

  • monitors the compliance of the activities of the regional (Minsk city) department, and Chairman of its Board with the Statute, decisions of the Conference and Council of The “Movement “For Freedom”;

  • monitors the financial and business operations of the regional (Minsk City) department;

  • controls the activities of the organization.

5.11. Meetings of the Audit Committee of the regional (Minsk City) department take place as often as needed, but at least once every four years.

5.12. The Chairman of the Audit Commission, who is elected at a meeting of the Audit Committee from its members for the period of four years, organizes the work of the Audit Commission of the regional (Minsk city) department.

5.13. The decisions of the Audit Commission are approved of by a simple majority of those present in the presence of at least half of its members.

5.14. The decisions of the Chairman of the city and district office may be appealed against to the office of the Inspector of the relevant regional (Minsk city) department.

The decisions of the Board and Chairman of the Board of the regional (Minsk city) department may be appealed against to the Audit Committee of the relevant regional (Minsk City) office.

The decisions of the Auditor of the city and district branch and of the Audit Committee of the regional (Minsk city) department may be appealed against to the Assembly of the city, district or regional (Minsk city) department or to the Audit Committee of The “Movement “For Freedom”.

5.15. Municipal, district and regional (Minsk City) offices have the same goals and objectives as The “Movement “For Freedom”, and act in accordance with the Statute of The “Movement “For Freedom”.

5.16. By decision of the Board of The “Movement “For Freedom” the city, district and regional (Minsk City) departments may be vested with the rights of a legal entity.

5.17. Municipal, district and regional (Minsk City) branches of The “Movement “For Freedom” are liquidated in the manner prescribed by this Statute and the laws of the Republic of Belarus.

5.18. Municipal, district and regional (Minsk City) branches of The “Movement “For Freedom” can be liquidated by the decision of the Board of The “Movement “For Freedom” in the following cases:

  • the lack of appropriate conditions for their establishment as provided in subparagraphs 5.2 and 5.6 of paragraph 5 hereof;

  • gross violations of this Statute;

  • systematic failure to implement decisions of the Conference and The “Movement “For Freedom”.

5.19. Municipal, district and regional (Minsk City) branches of The “Movement “For Freedom” have no right to dispose of the property that belongs to The “Movement “For Freedom”.

6. Highest and the elected bodies of The “Movement “For Freedom”

6.1. The supreme body of The “Movement “For Freedom” is the Conference, which is convened by the Board of The “Movement “For Freedom” at least once every four years.

6.2. The Conference is convened by the decision of the Board of The “Movement “For Freedom”, and may also be convened at the request of at least a third of the members of The “Movement “For Freedom”.

6.3. A notification about the agenda and timing of the Conference shall be sent to all members of The “Movement “For Freedom” not later than a week before the Conference.

6.4. The Conference is held under management of the Chairman of The “Movement “For Freedom” or on his behalf — under management of the First Deputy Chair or one of the deputy heads.

6.5. The Conference is considered competent if more than half of the elected delegates are present. Delegates to the Conference are elected by the municipal, district and regional (Minsk city) departments of The “Movement “For Freedom” according to the norm determined by the Board of The “Movement “For Freedom”.

In the administrative-territorial units of the Republic of Belarus, on the territory where there are no registered or assigned offices, general meetings of The “Movement “For Freedom” may be held, if there are members who reside on this territory, who elect delegates to the Conference according to the norm of the department, assigned by the Council.

In nominating delegates to the conference, each member of The “Movement “For Freedom” has one vote and is entitled to participate in a general meeting of the administrative-territorial unit or a meeting of the organizational structure.

6.6. The Conference shall take decisions by a simple majority vote of those present in the presence of a quorum, except for the adoption of decisions on the amendments and additions to the Statute, reorganization or liquidation of The “Movement “For Freedom”, which are taken by 2/3 of votes in the presence of a quorum. The form of voting is determined by the Conference.

6.7. At the invitation of the Board of The “Movement “For Freedom” the representatives of Belarusian and foreign organizations and mass media can participate in the Conference as guests.

6.8. The Conference has the right to consider any issues regarding the activities of The “Movement “For Freedom”.

The competence of the Conference of The “Movement “For Freedom” includes:

  • approval of the name of the Statute of The “Movement “For Freedom”, amending it and (or) adding necessary information, unless otherwise is provided by this Statute;

  • defining the main activities of The “Movement “For Freedom”;

  • election from the members of The “Movement “For Freedom” for a period of 4 years and a recall by open or secret ballot (by the decision of the Conference) of the Chairman of The “Movement “For Freedom”, the First Deputy Chairman of The “Movement ‘For Freedom’ and Vice-Presidents of ” The “Movement “For Freedom” in the amount determined by the decision of the Conference of The “Movement “For Freedom”;

  • election of the Board of The “Movement “For Freedom” in the number of at least five members for the period of 4 years;

  • election of the Auditing Commission of The “Movement “For Freedom”, composed of five members and the chairman of the Audit Commission of the selected members of the committee for the period of 4 years;

  • review and approval of the reports of the Chairman of The “Movement “For Freedom” and the chairman of the Audit Commission of The “Movement “For Freedom”;

  • termination of the decisions of The “Movement “For Freedom” in cases of non-compliance with the legislation of the Republic of Belarus and this Statute;

  • adoption of decisions on reorganization or liquidation of The “Movement “For Freedom”.

6.9. Between the Conferences, the activities of The “Movement “For Freedom” are governed by the Board of The “Movement “For Freedom”, which is the governing body of The “Movement “For Freedom”.

6.10. Meetings of the Board of The “Movement “For Freedom” are held as often as needed, but at least twice a year.

6.11. The Chairman of The “Movement “For Freedom”, First Deputy Chairman of The “Movement “For Freedom” and the Deputy Chairman of The “Movement “For Freedom” are included in the Board of The “Movement “For Freedom”.

The management of the activities of The “Movement “For Freedom” is carried out by the Chairman of The “Movement “For Freedom” and in his absence by the Deputy Chairman of The “Movement “For Freedom”.

6.12. Meetings are convened by the Chairman of the Board of The “Movement “For Freedom”, and in his absence by the First Deputy Chairman of The “Movement “For Freedom”.

6.13. Meeting of the Council may be convened at the written proposal of 1/3 of the members of the Board of The “Movement “For Freedom” or by a decision of the Auditing Committee.

6.14. Council meeting is considered competent if it is attended by more than half of its members.

6.15. Council decisions are approved of by open vote by simple majority vote of those present in the presence of a quorum.

6.16. Members of the Audit Committee may attend meetings of the Board in an advisory capacity.

6:17. The Board of The “Movement “For Freedom”:

  • accepts and excludes members of The “Movement “For Freedom”;

  • awards the title of "Honorary member of The “Movement “For Freedom”;

  • approves of the symbolism of The “Movement “For Freedom”;

  • develops strategies and tactics of The “Movement “For Freedom” in key areas;

  • approves programs and projects in key areas;

  • decides on the convening of the Conference;

  • defines the rules of representation of delegates to the Conference of the departments and administrative units;

  • decides on the establishment and liquidation of structural divisions, giving them the rights of legal entities;

  • decides on the establishment of the Council of permanent and temporary commissions, working groups, required to implement the decisions of higher and elected bodies of The “Movement “For Freedom”;

  • decides on the establishment and liquidation of commercial and non-profit organizations and institutions, becoming the founder of the mass media;

  • hears the reports of the Chairmen of the structural departments, heads of organizations and institutions established by The “Movement “For Freedom”;

  • creates, if necessary, for the period of the activities of the Council, the Executive Committee of The “Movement “For Freedom” with at least three persons;

  • decides on the acquisition of property, as well as the disposal of property and funds of The “Movement “For Freedom”;

  • approves samples, stamps and blanks of The “Movement “For Freedom”;

  • develops and approves regulations and other documents necessary for the regulation of the activities of The “Movement “For Freedom” and does not contradict the legislation of the Republic of Belarus and the present Statute;

  • keeps records of members of The “Movement “For Freedom” by identifying the person responsible for keeping records of the members of The “Movement “For Freedom”;

  • between Conferences, make changes and (or) additions to the Statute of The “Movement “For Freedom”, due to changes in legislation, or changing the legal address of The “Movement “For Freedom”;

  • decide on other issues that are not within the competence of the Conference, Chairman of The “Movement “For Freedom” and the Audit Committee.

6.18. The Board is accountable to the Conference of The “Movement “For Freedom”.

6.19. The executive body of The “Movement “For Freedom” is the Executive Committee, which may be generated from the members of The “Movement “For Freedom” by the Board of The “Movement “For Freedom” for the period of the Council, which created it.

The quantitative composition of the Executive Committee of The “Movement “For Freedom” is determined by the Board of The “Movement “For Freedom”, but is created when at least three people are participating.

The Executive Committee of The “Movement “For Freedom”:

  • organizes the implementation of decisions of the Conference, the Board of The “Movement “For Freedom”;

  • resolves other issues regarding statutory activities that are not within the competence of higher and other elected bodies of The “Movement “For Freedom”.

6.20. The Chairman of the Executive Committee who is appointed by the Board of The “Movement “For Freedom” for the period of the activities of the Executive Committee, organizes and manages its activities.

6.21. Meetings of the Executive Committee shall be convened by its chairman when necessary, but not less than once every four months.

Decisions of the Executive Committee shall be approved by a simple majority of those present, if the meeting was attended by more than half of its members.

6.22. Chairman of The “Movement “For Freedom” is the head of the legal entity.

Chairman of The “Movement “For Freedom”:

  • provides overall guidance of the activities of The “Movement “For Freedom”;

  • distributes duties among members of the Board and instructions to them;

  • determines the date of the Board meeting and leads them;

  • brings before the Council any questions related to the activities of The “Movement “For Freedom” which do not fall within the competence of the Conference, the Board and the Audit Committee;

  • represents the interests of The “Movement “For Freedom” in relations with Belarusian and foreign citizens and legal entities;

  • signs agreements, contracts, declarations, appeals on behalf of The “Movement “For Freedom”;

  • signs decisions of the Council of The “Movement “For Freedom”;

  • opens settlement and other bank accounts;

  • performs other functions that are not within the competence of other bodies of The “Movement “For Freedom”.

6:23. The Chairman of The “Movement “For Freedom” may prematurely terminate his authority on his own initiative. In this case, he submits a written application, which should be considered at a meeting of the Board of The “Movement “For Freedom” within one month at most from the date of submission of an application.

6:24. The Chairman of The “Movement “For Freedom” is accountable to the Conference.

6:25. The Vice-Presidents of The “Movement “For Freedom” act within the limits of their competence identified in the Statute, and are responsible for the scope of activities defined by the Chairman of The “Movement “For Freedom”, and are accountable to the Council and the Conference.

First Deputy Chairman of The “Movement “For Freedom” provides guidance to The “Movement “For Freedom” in the absence of the Chairman of The “Movement “For Freedom”, coordinates the interaction between the bodies of The “Movement “For Freedom” and its organizational structures for their authorized activities, represents the interests of The “Movement “For Freedom” in relations with Belarusian and foreign citizens and legal entities.

6:26. Decisions of the collegial bodies of The “Movement “For Freedom” are recorded in the protocol. All the paperwork is carried out in accordance with the legislation.

7. Audit Committee. The procedure for appealing against the decisions of elected bodies of The “Movement “For Freedom”

7.1. The auditing body of The “Movement “For Freedom” is the Audit Committee composed of five members.

7.2. The Audit Commission organizes and monitors the compliance of the activities of The “Movement “For Freedom” in accordance with the law and this Statute, as well as monitors its financial activities.

7.3. Members of the Audit Committee and its chairman shall be elected by the Conference for the period of four years. The members of the Audit Committee may not be members of the Council of The “Movement “For Freedom” and the governing bodies of organizational structures of The “Movement “For Freedom”.

7.4. Meetings of the Audit Committee shall be convened by its chairman and conducted as necessary, but not less than once every four years.

7.5. The meeting of the Audit Commission shall be valid if attended by more than half the members of the Audit Commission.

7.6. Decisions of the Audit Commission shall be adopted by an open vote by a simple majority of those present in the presence of a quorum.

7.7. Decisions of the Board, the Chairman, the First Deputy Chairman of the The “Movement “For Freedom”, the Vice-President of The “Movement “For Freedom”, the Executive Committee, Chairman of the Executive Committee can be appealed against to the Audit Committee, in addition except for the decision on the exclusion of the members of the Association.

7.8. The Audit Commission may independently take into consideration any decision of the Council, Chairman, First Deputy Chairman of The “Movement “For Freedom”, the Vice-Presidents of The “Movement “For Freedom”, the Executive Committee, Chairman of the Executive Committee according to the relevant legislation and the present Statute.

All the materials and documents necessary for carrying out inspections and complaints are presented to the Audit Commission.

7.9. The decision of the Audit Commission to verify the electoral authorities’ decisions or the complaint is sent to the appropriate authority. The decision of the Auditing Committee shall be considered within a month and the response sent to the Audit Commission and the applicant.

7.10. Decisions of the Audit Commission may be appealed against to The “Movement “For Freedom”. The Conference may take into consideration any question of appeal against unlawful actions of officials and the elected bodies of the association and its branches.

7.11. The Audit Commission is accountable to the Conference, and at least once every four years, submits a report on its work to the Conference.

8. The funds and property of The “Movement “For Freedom”

8.1. The “Movement “For Freedom” may own property necessary for material support of its activities, except for the objects which by law can only be in state ownership.

8.2. The owner of all property belonging to the The “Movement “For Freedom” is the The “Movement “For Freedom” as a whole. Each individual member of The “Movement “For Freedom” has no ownership of the share of property owned by The “Movement “For Freedom”.

8.3. Property and funds of The “Movement “For Freedom” are comprised of voluntary contributions from individuals and legal entities, the income from lectures, exhibitions, seminars and other events, other income not prohibited by legislation.

8.4. The “Movement “For Freedom” has the right to engage in entrepreneurial activities required to achieve the statutory purposes only through the creation of commercial organizations and (or) participation in them in accordance with the legislation of the Republic of Belarus.

8.5. Funds and property, which are received by The “Movement “For Freedom”, can only be used to carry out the statutory goals and objectives.

9. Accounting in The “Movement “For Freedom”

9.1. The “Movement “For Freedom” keeps operative, bookkeeping and statistical records in accordance with the legal regulations.

9.2. Responsibility for the accounting, the timely provision of accounting and statistical reporting rests with the Chairman of The “Movement “For Freedom” as the head of the legal person whose competence is determined by the legislation.

9.3. The Board of The “Movement “For Freedom” is responsible for the storage of all association documents.

10. Liquidation of The “Movement “For Freedom”

10.1. Liquidation of The “Movement “For Freedom” can be made by the Conference or the Supreme Court of the Republic of Belarus in the manner prescribed by the legislation of the Republic of Belarus and the present Statute.

10.2. Reorganization of The “Movement “For Freedom” can be made by the Conference in the manner prescribed by the legislation of the Republic of Belarus and the present Statute.

10.3. The decision on reorganization or liquidation of The “Movement “For Freedom” is valid if it receives more votes than 2/3 of the members present at the Conference.

10.4. The liquidation is carried out by the liquidation committee, which is created by the body that made the decision on liquidation.

10.5. Funds and property of The “Movement “For Freedom” remaining after full satisfaction of the property claims of creditors, are used for the purposes stipulated by the present Statute, if the funds and other property of The “Movement “For Freedom” in accordance with legislative acts are not subject to trading for the benefit of the state.
